Applicant and sponsor typically give separate oral evidence. Member asks detailed questions about the relationship. Consistency and genuine detail carry the day.

After the hearing

Written decision follows. Favourable decisions either direct grant or remit the matter to the Department with instructions. Adverse decisions open Federal Circuit review if legal error.

Partner visa appeals have one of the strongest success rates at the ART, but they succeed on preparation.

The Department often refuses on relationship evidence grounds that can be addressed with updated, organised evidence and compelling oral testimony. A rushed or unrepresented appeal rarely succeeds; a well-prepared one frequently does.

Can I keep working while on a bridging visa during the appeal?
Usually yes. The bridging visa typically carries the previous visa's work rights. See BVA guide.

Usually yes. Partner ART hearings nearly always involve both parties giving oral evidence. Preparation for both is essential.
How long does a partner ART appeal take?
Typically 12 to 24 months from lodgement to hearing. Wait times vary by location and case complexity.
Can the relationship evidence updated at appeal go back to include events after the original refusal?
Yes. The ART considers the relationship at the time of the Tribunal decision, not the time of the Department decision. Events after refusal are admissible and often important.
