6 Months to 2+ Years · Visa Type · Tribunal Workload

ART appeal timeframes vary wildly. From 6 months to over 2 years.

The type of visa, the complexity of the case, and the Tribunal workload all change the answer. This is what the 2026 timelines actually look like, based on cases we represent and Tribunal published data.

Current timeframes by visa type

Four bands of appeal duration.

ART appeal duration is not uniform. Different case types cluster in different bands.

Student and graduate visas (6-12 months)

Typically faster. Documentary evidence, less frequent oral hearings, shorter submissions. Student appeals.

Skilled migration (12-18 months)

Evidence-focused cases. Hearings rare for many points or skills assessment disputes. Skilled appeals.

Partner and family (12-24 months)

Oral hearings common. Relationship evidence requires development. Partner appeals.

Character and cancellation (varies widely)

Urgent cases expedited. Complex matters can take 18-30 months. Mandatory cancellations have stricter timing rules. Cancellation appeals.

Why timeframes vary

Four factors. Not all within applicant control.

Appeals lodged the same day can land months apart in scheduling. Here is why.

Tribunal locationSydney and Melbourne registries have larger caseloads. Perth and Adelaide sometimes move faster. Case is assigned to applicant location.
Tribunal workloadNational caseload fluctuates. Refusal volumes from the Department directly affect ART timing.
Case complexityStraightforward documentary cases process faster. Multi-issue matters with hearings take longer.
Party preparationWhere parties request extensions or delay evidence submission, the appeal timeline extends.
Planning the wait

Three practical strategies.

While waiting, applicants can take specific steps to improve timing and outcome.

Lodge complete evidence early

Complete submissions at lodgement reduce Tribunal requests for further evidence, which add weeks or months.

Priority processing requests

Compelling circumstances (medical, family, work) can justify priority. Evidence-backed requests.

Maintain bridging visa awareness

Your bridging visa during appeal has conditions. Understand them and comply.

ART expedite requests are granted in a minority of cases, but where granted can save 6-18 months.

Demonstrable urgent need (imminent medical treatment, bereavement, time-sensitive employment) is the strongest priority basis. Routine anxiety about waiting or general inconvenience rarely justifies expedited processing.

Common questions

The questions we hear most.

For ART appeal timing and priority requests, book with Sourabh Aggarwal.

How long will my bridging visa last during ART appeal?
Typically until the appeal is decided, assuming it is in effect at lodgement. Specific conditions vary. See BVA guide.
Can I request priority ART processing?
Yes, with supporting evidence of compelling circumstances. Not every request succeeds, but where granted can shorten timelines significantly.
Does hiring a lawyer speed up my appeal?
Not directly; the Tribunal decides scheduling. But complete, high-quality evidence packages reduce requests for further information and hearing complications, which can meaningfully shorten the overall duration.
Can the Department expedite the decision if the appeal is favourable?
Where the Tribunal remits the matter to the Department, the Department's subsequent processing can sometimes be expedited. Case-by-case.
