Condition 8202 · Enrolment, Attendance, Academic Progress

8202 looks innocuous, but it controls the single most common student visa cancellation ground.

Drop below attendance thresholds, fail progress, or let your CoE lapse, and your student visa is at risk.

Quick answer

Continuous enrolment, satisfactory attendance, satisfactory progress.

Breach is the leading cause of student visa cancellation. The Department acts through the Provider Registration and International Students Management System (PRISMS).

The three core requirements

Enrolment. Attendance. Progress.

All three must be maintained for the life of the visa.

Enrolment

Remain enrolled in a CRICOS-registered course at all times. Gaps between courses, unauthorised leaves of absence, and unreported withdrawals all breach 8202.

Attendance

Most institutions require 80 percent attendance. Falling below this threshold is reported to the Department through PRISMS.

Academic progress

Satisfactory progress means passing units and maintaining an acceptable GPA. Two consecutive failed units or a pattern of withdrawals often triggers unsatisfactory progress reporting.

What happens if your institution reports you

Internal appeal first, then NOICC, then cancellation.

The process has multiple windows to save the visa.

Internal provider process firstAn institution that reports a student under 8202 must follow an internal complaints and appeals process first. The student has the right to respond.
NOICC if Department actsIf the Department decides to proceed, a Notice of Intention to Consider Cancellation is issued. The student has 28 days to respond.
Strong NOICC responses explain circumstancesSerious illness, family crisis, domestic violence, unexpected relocation. Evidence of what has stabilised since.
ART appeal if cancelledIf cancellation proceeds, ART appeal within 21 days preserves review rights.

Strong NOICC responses explain what went wrong and show stabilisation.

Serious illness, family crisis, domestic violence, unexpected relocation. Plain apologies without evidence rarely succeed. Institution support letters and evidence of academic intervention are valuable.

Frequently asked

Condition 8202 questions.

If condition 8202 affects your visa, book a consultation with Sourabh Aggarwal.

Can I take a break from study?
Only with approved Leave of Absence from your institution, for genuine compelling reasons (medical, family emergency). Personal preferences do not qualify.
What if I fail subjects?
Occasional failures do not automatically breach 8202. Repeated failures, failing over 50 percent of units in a semester, or patterns of disengagement trigger unsatisfactory progress reporting.
Can I work full-time during exam periods?
8105 work hour caps apply separately from 8202. Work hours are capped regardless of study intensity.
My provider cancelled my course. What happens to my 8202?
You must find a replacement course within a reasonable period, usually 28 days. The Tuition Protection Service helps students in this position.
