Couples often have children during the partner visa processing period. Congratulations are in order, and so is some careful paperwork.

A newborn to an Australian citizen parent is usually an Australian citizen by descent. A newborn to two non-citizen parents needs to be added to the visa application. The timing matters.

Citizenship status of the parents determines the pathway for the newborn.

Australian citizen parent (most common)

Newborn is an Australian citizen by descent if the birth is in Australia, or eligible for citizenship by descent if born overseas to an Australian citizen parent.

Non-citizen parents (both applicant and sponsor on visa)

Newborn needs to be added to the partner visa application as a dependent. Lodged through ImmiAccount.

Sponsor is citizen but child born overseas

Register the child for citizenship by descent. No need to add to partner visa.

Early disclosure to the Department

Regardless of scenario, notify the Department of the birth promptly. Notification is part of the visa obligations.

Australian citizenship by descent

The usual outcome for partner visa children.

Because the sponsor is typically an Australian citizen or PR, many newborns qualify for citizenship directly.

Born in Australia to a citizen or PRUsually Australian by birth. Australian birth certificate is evidence. No visa needed.

When it applies and how.

If the child is not automatically an Australian citizen, adding them to the partner visa is usually the right path.

When to add

Before the partner visa is decided. Adding children after decision is more complex and sometimes not possible.

How to add

Notification through ImmiAccount with birth certificate and identity evidence. Department may request updated police checks for the child later.

Timing with pregnancy

If pregnancy is known, mention it in the application. If birth happens during processing, notify promptly.

A child of an Australian citizen has Australian citizenship from birth even if born overseas.

Many parents assume the child needs to be "added" to the visa. If the sponsor is an Australian citizen and the child is biologically theirs, the child is an Australian citizen regardless of where they were born. Registration and passport are the next steps. See descent for details.

If the sponsor is an Australian citizen, apply for citizenship by descent. If the sponsor is a PR only, the child may need to be added to the partner visa or apply for a different dependent visa.
How quickly should I notify the Department?
Within a reasonable time of birth. Migration obligations include notification of significant changes including births.
Can the birth speed up my partner visa?
Sometimes. Having Australian citizen children can be a compelling compassionate factor for priority processing requests.
What if the birth is between 820 grant and 801 grant?
Birth certificate becomes part of the 801 continuing relationship evidence. Strengthens the case significantly.
